Three years after Aboriginal elder Mr Ward was cooked to death in the back of a prison van travelling from Laverton to Kalgoorlie, charges have been laid against the four parties found responsible by coroner Alistair Hope. The parties prosecuted are the Western Australian Department of Corrective Services, the private prison van contractor G4S (formerly GSL) and the two drivers of the prison van. State government workplace safety agency WorkSafe laid the charges under the Occupational Safety and Health Act.

Hundreds of Aborigines and supporters are preparing to defend the kutalayna Aboriginal site in Tasmania’s lower Jordan Valley, in a protest that some say has the potential to be as big as the huge Save Franklin River protests of the 1980s. In dispute is the route of the Brighton bypass highway, north of Hobart. The Tasmanian government is pushing ahead with a bridge that will damage the historic site. Aboriginal activists and their supporters want the bridge to be moved at least 300 metres away. Already the campaign has drawn support from high-profile figures.

Australia Day is traditionally the most racist day of the year for Aboriginal people. When people celebrate on January 26, there is no escaping the fact they are celebrating the day that one race of people invaded another race of people’s country and took control of Aboriginal lands and tried to dominate Aboriginal people. Invasion Day, as it should be called, celebrates the dispossession of land, culture, and way of life of Aborigines.

Despite efforts by teachers, the Australian Education Union (AEU) leadership prevented a motion in support of Melbourne’s only Aboriginal school from being put to the AEU state council. A speaker from the College was also denied the opportunity to address AEU Council. AEU councilor Mary Merkenich said she was disappointed that AEU councilors didn’t get a chance to hear that the Ballerrt Mooroop College in Glenroy is under threat and why its school community has been organising a community sit-in in the school gymnasium.

As indigenous peoples, we are extremely concerned that the principles agreed upon in the Cochabamba People’s Agreement have been unilaterally removed from the negotiating document [for the Cancun climate conference] that was released on November 24. Equally alarming is the misrepresentation of the Copenhagen Accord as a legitimate path forward, despite its widespread denouncement by civil society and its tepid reception last December in Denmark, when the United Nations merely “took note of” it.

A new report from the Centre for Aboriginal Economic Policy Research (CAEPR) casts doubt on the ability of current government and corporate policy to meet its goal of “closing the gap” between Aboriginal and non-Aboriginal unemployment. The CAEPR report looks at the goals and achievements of two private-sector initiatives: the Australian Employment Covenant and Generation One.

The 2011 UN climate conference in Cancun, Mexico, is not expected to agree to sharp cuts in greenhouse gas emissions. But the UN and rich nations will push for the conference to endorse a carbon trading scheme to protect forests, known as Reduced Emissions from Deforestation and forest Degradation (REDD). Below is an “open letter to the indigenous peoples of the world” from Bolivian President Evo Morales. Released in September, the letter calls for the protection of the world’s forests, and also for opposition to REDD and other carbon trading schemes. ***

Representatives of 76 indigenous peoples said they reject market-based mechanisms as a false solution to the climate crisis at a recent international conference. They said UN-backed carbon trading schemes such as Reduced Emissions from Deforestation and forest Degradation (REDD), “are offered as solutions but have negative impacts and cause divisions among indigenous peoples, whose access and control of forest resources are eroded”.

The Aboriginal Rights Coalition (ARC) held the "Deadly Dance 4 Justice" on November 19, which drew 100 people to the Globe Theatre for a night of live music, poetry and spoken-word performance, and raised more than $1500 for campaigns. The latest appeal against Stockland's Sandon Point development was dismissed on November 25, clearing the way for development. The case has been in the Land and Environment Court since August. The appeal was launched by the Sandon Point Aboriginal Tent Embassy (SPATE), which has been campaigning against the development for 10 years. The community campaign has opposed the Sandon Point development because of impacts on the environment and Indigenous cultural heritage, as well as a lack of transparency and democracy in the approval process.

If at first you don’t succeed, redefine success. This phrase has become the unofficial motto of this year’s United Nations climate conference in Cancun, Mexico. A week out from Cancun, which runs over November 29 to December 10, there is little hope of meaningful progress. Yet key players have sought to throw a shroud of official optimism over the looming failure. Few Western politicians want a repeat of last year’s Copenhagen climate conference. They consider it a public relations disaster.
