Injustice at 'Goonininup

By Lisa Macdonald On April 20 the High Court rejected an application by Yaluritja (Clarrie Isaacs) to appeal against a Supreme Court of WA decision to allow the issuing of six liquor licences at the indigenous people's sacred site of "Goonininup" (the Old Swan Brewery) in Perth. Yaluritja opposed the decision to allow the construction of a multi-million dollar tourist complex containing six alcohol outlets by Multiplex/Bluegate Nominees on the basis that it was not in the public interest. According to Yaluritja, "the granting of liquor licences on a registered indigenous people's sacred site is very offensive to the beliefs of the Nyungah People who have been fighting over many years to have the land returned to a park for all people to share. I also appealed because doctors said the site was a dangerous 'blackspot' in which increased traffic volume will increase the risk of trauma especially when alcohol has been consumed." Ninety Perth doctors have signed a statement expressing opposition to the development. The old brewery has been the site of a long-term community campaign to protect the area. In losing the appeal, Yaluritja has been ordered to pay $21,755.44 in court costs to Bluegate. John Roberts, himself a multi-millionaire, has instructed his lawyers to collect the money "without further notice" with the result that Yaluritja could lose his home. "This sets a terrible precedent for future action by the community on any issue. How will they feel about using the justice system to have their rights heard when they are likely to be burdened by such costs if they lose? It is an unjust decision which must never be allowed to happen again."
