Plant ownership laws under review

The Plant Breeders Rights (PBR) Bill 1994, which is to replace the Plant Variety Rights (PVR) Act 1987, is now open for public review.

The name change signals a general shift in focus and intent, according to the Australian Gen-Ethics Network. Protection for other affected groups, written into the PVR Act after much public debate, would be removed.

It is claimed that all the changes are needed to satisfy the 1991 UPOV Convention (an international treaty on the ownership of plant varieties), but the bill goes much further in sweeping away protection for the public interest. The 1991 convention was heavily influenced by transnational seed and agribusiness companies.
